HABR#  13- 05: Application  of2  Kopak Lane for review  of a new single-family residence.  The premises  are located  on the north side ofKopac   Lane, 200 feet west of Route 9W in the Town of Orangetown,   Hamlet  of Palisades,  New York.  Chapter  12, Section  12-4(A),  Historic  Areas Board  of Review.

Tax Numbers:  78.13 I 1  I 3. l; R-40 zoning district.

 

Heard by  the  HISTORIC  AREAS  BOARD  OF  REVIEW  at  meetings  held  on the following Tuesdays, May 14, 2013 and June 1, 2013 at which time the Board made the following determination:

 

Marc Comito, Contractor, Robert Hoene, Architect, and Mr. and Mrs. Defelice, owners, appeared and testified.

 

The applicant presented the following:

 

  1. Architectural plans dated 01/05/2013 not signed or sealed by Robert Hoene, Architect.
  2. Site plan dated 04/22/2013 signed and sealed Jay Greenwell, LS ..
  3. A computer generated picture of the proposed house.

 

 

 

At the meeting of May 14, 2013, Robert Hoene, Architect, stated that the rendering depicts the house; that it will have stone on all four sides; that it is 37′ to the peak and 29′ to the mean height; that it does not require a height variance; that the chimney will also

be stone; that the garage doors will be carriage style doors; that they are proposing 1 O’ ceiling height on the first floor and the proposed roof pitch is 10 on 12; that they could adjust the first floor ceiling height to 9’from 10′ and adjust the second floor ceiling height to 9′ instead of 10′ and make the roof pitch 9 on 12 to lower the height; and that the air conditioning unit will be in the back on the northwest side and it will be screened with landscaping.

 

Mark Comito stated that the elevation of the first floor is set at this elevation in order to

have the proper pitch to the storm drain in the street; that the stormwater system in thq    ~      (3

street was done at the time of the subdivision; that the berm is also part of the subdi”ionr_     ~ plan; that the berm does not belong to this property; that the Town requires a footingZ     ~      o drain to drain to daylight; and that they would like a continuance to investigate if the~a~           ~

Christine Defelice stated that the berm is still owned by LeMar; that the ownership ofdhc :3       ~

berm will be turned over to the Home Owners Association when the last lot of the.     ~     ;;:. ~        6

subdivision is sold; that she does not own the berm; and that she cannot do any work c·iP~   ·.~..C ‘    ·z=E

that property.

 

PUBLIC COMMENT: No public comment.

 

The following items were submitted for review at the June 11, 2013 meeting:

 

  1. Revised  Architectural  plans   with  the  latest  revision  date  of 05/30/2013  by Robert

Hoene, Architect.

 

 

  1. Site Plan with the latest revision  date of 05/31/2013  signed and sealed by Jay

Greenwell,  land Surveyor.

  1. Four photo  copies  of photographs   of the berm  and the lot.

 

 

 

At the meeting  of June  11, 2013 Jay Greenwell,  Land  Surveyor,  Robert Hone, Architect, Robert  Knoebel,  Attorney,  Mark Comito,  Contractor,  Emilio  and Christine  Defelice appeared.

 

Robert Hoene, Architect,  stated that they have adjusted  the first floor ceiling to 9′ from

10′, they have lowered  the second  story ceiling height  from 9′ to 8′ and the pitch of the roof went from  10 on 12 to 9 on 12; that when all of these items  added up, lower the structure by 3  V2 feet.

 

Jay Greenwell,  Land  Surveyor,  stated that he did the original  subdivision  layout; that he has spoken to the Department  of Transportation   and has been given permission  to drain this lot into the catch basin  on Route  9W; that this catch basin is lower than the catch basin  in the street; that this will drop the elevation  level from  197 .8 to 196; that this change  along with the architectural  changes  lowers the house by 5.3 ‘;that   he relative elevation  of the home  on Lot #3 is +6.1′  over the road  (9W) and that the home  on Lot #2 is +6′  over the road (9W) and compared  to Lot #1 which  is _6.1′  over the road and now

4.1′ over the road (9W); and that they have gone as far as they  can to accommodate  the

concerns  of the Board.

 

Robert  Knoebel,  Attorney,  stated that he was not present  at the beginning  of the application  but he would  ask the Board to understand  that there are some limitations because  of the drainage  from the lot; that he spoke to the Board’s attorney  and that the maximum  height of the house  was known  at the time that the berm  and subdivision  were approved.

 

Mark  Comito  stated that they have  done tests on the property  and they hit ground  water at

184; that any drywell  installed  would  be a wet well; that he would  not build a new house with pumps  for the basement;  that it wouldn’t make  sense to depend  on a machine  when the footing  drain can be drained properly  without  that;  and that the house is 80’  from Route  9W.

 

 

 

 

Public  Comment:

 

Carol Baxter,  34 Lawrence  Lane,  Palisades,  N. Y., stated that she came to meetings  when the property  was before the Boards  for subdivision;  that Lenar changed hands  and now the public  would  have to attend  Board  meetings  16 times regarding  each house; that they fought for the berm; that if the house is raised up so close to Route 9W it will be a noisy house; that the homeowners   should  screen  it.

 

Lynn  Sandhouse,  201Route9W,  Palisades  asked if these houses  exceed the height limitation.

 

Milbry Polle, 236 Route  9W, Palisades,  NY, stated that she lives on Route 9W and the noise  is incredible;  that the applicants  should plant trees to avoid the noise.

 

Blythe  Anderson  Chase,  286 Route  9W, Palisades,  NY, stated that she is an abutting property  owner; that she grew up in the house  at 286; that the noise  from Route  9W is terrible;  that the berm  is not planted  t~1j!J~l~~t\’~0D1fthe               houses  were raised

up too high.

Susan Nemesdy,   19 Lawrence  Lane, Palisades,  NY, wanted  to know how the Historic Board  could allow house to be built in the Historic  District  that look like they belong  in Closter,  New Jersey; and questioned  exactly  what the Board  is charged  with; and stated that the berm  should be higher.

 

 

 

Andy  Fowler,  5  Hey Hoe Woods  Road,  Palisades,  NY, asked if the water is being pumped  or does it flow by gravity.

 

 

 

FINDINGS OF FACT:

 

 

The Board,  after personal  observation  of the property,  hearing  all the testimony  and reviewing  same, found as fact, that: The application  as presented,  would  not adversely  affect the Historic  District  and the surrounding  area. The design and

materials  for the proposed  house( Architectural  plans  dated  06/20/2013,  not signed or sealed by Robert Hoene,  Architect;  Site plan dated  04/19/2013  signed and sealed  Jay

Greenwell,  L.S.)   are complimentary   to the District.

 

 

  1. The exterior  facade  shall be Boral  Stone White  Oak Country  Ledgestone   with off-white  stucco  trim and frieze board.  Soffit and fascia to be vinyl/aluminum almond.  Porch  columns  to be painted  off white.

 

  1. The roof shall be Tamko  Heritage  Virginia  Slate color, architectural   style shingles.
  2. The entry (front)  porch shall have a limestone  floor with  limestone  treads and matching  stone risers  .
  3. The windows  shall be Pella Brand,  sizes as per plan, off-white  or almond  exterior

with bonded  simulated  divided  light included  on all windows.

  1. The exterior  doors:  (a) entry-Masterpiece   Classic  French  Door (Unit FlO), (b) Breakfast  room-Pella  Architect  Series 6′ x 8′ slider;  (c) Family  room-Pella Architect  Series,  in swing (2) 5′ x 8′;  (d) Mud room-Therma   Tru TS262,  in swing

3′ x 7′;  (e) Garage-fire-rated,  self closing  hinged  ThermaTru  or equal-  3′ x 7′.

  1. Aluminum  seamless  gutters  and leaders  to be off-white.
  2. The garage doors shall be Clopay or CHI carriage  style (white)  with divided  light windows.
  3. The driveway  shall be Macadum  (blacktop).
  4. Front porch to be limestone.  Steps to be limestone  treads and matching  stone nsers.

HABR#  13- 07: Application   of Richard  Descherer  for review  of a raise in height elevation  of an existing  single-family  residence  out of the flood plain.  The premises  are located  at 1  Washington   Spring Road, in the Town of Orangetown,  Hamlet  of Palisades, New York.  Chapter  12, Section  12-4(A),  Historic  Areas Board  of Review.

Tax Numbers:  78.19 I 1  I 5; R-22 zoning district.

 

Heard by the HISTORIC AREAS BOARD OF REVIEW at a meeting held on Tuesday, June 11, 2013 at which time the Board made the following determination:

 

 

 

William Bosley, contractor, Richard and Jennie Descherer, John Murray, Architect, and

Matt Warner, Architect, appeared.

 

The following documents were presented:

 

  1. Site Modification Plot boundary & Topographic survey dated 01/27/2013 with the latest revision date of 04/25/20013 signed and sealed by Steven J. Collazuol, P.E..
  2. Architectural plans dated 04/12/2013 with the latest revision date of 04/25/2013 signed and sealed by John Burnside Murray, Architect.
  3. A cover letter dated May 16, 2013 from Richard and Jennie DeScherer (2pages).
  4. A memorandum dated April 30, 2013 from Langan Engineering Environmental, Surveying and Landscape Architecture, D.P.C. (4 pages).

 

John Murray, Architect, stated that Super Storm Sandy took out the lower portion of the house; that Bill Bosley dried the house out; that a permanent solution to flooding was looked into; that engineers that specialize in lifting structures were hired; that the plan is

to lift the house ten feet seven inches (1 O’ 7”) and place it on pillars that will drilled down into the bedrock and reinforce it with steel beams; that the pillars would then be covered with break away walls that would match the facade of the existing house; that this is necessary in order to preserve the house and make it insurable in the future; that these proposed walls are designed to break apart in case of another storm like sandy; that the first floor of the house would be safely outside of the rise of the river; that the northern wing of the house is constructed of palisades stone as are the chimneys and they will be lifted and more Palisades stone will be added to the structure in that section; that raising the house in this way will result in a pleasing way to compliment the mansard design.

 

Bill Bosley stated that when the storm hit, it did so with such force that it broke several windows; that this was actually a good thing because it relieved some of the pressure on the existing walls and prevented the collapse of the walls; that the pool house in the rear is not being raised because it did not sustain any damage; that there will be an elevator installed to take the residents to the first floor; that the elevator will automatically go to the first floor and stay there when not in use, ensuring that it will not get damaged if another storm occurs.

 

Richard Decsherer stated that they did have a fire twelve years ago and do not want to have to live through another storm like Sandy without fixing problem.

PUBLIC  COMMENT:

 

Carol Baxter,34  Lawrence  Lane, Palisades,  NY, stated that the house  is a gem; that she was very concerned  about what would happen  to the house after the storm; and that she is very happy  to hear that it is being  fixed; that the Descherer’s keep the property  beautiful.

 

Lynn  Sandhouse,  210 Route 9W, Palisades,  stated that she agrees with  Carol and would like to commend  the team for the job they are doing.

The design  and materials  for the proposed  house(Site  Modification  Plot boundary  & Topographic survey dated 01/27/2013  with the latest revision  date of 04/25/20013   signed and sealed by Steven J. Collazuol,  P.E.; Architectural  plans  dated 04/12/2013  with the latest revision  date of 04/25/2013  signed  and sealed  by John Burnside  Murray, Architect)   are complimentary   to the District.

 

  1. The exterior  facade  shall be custom  color DeScherer  Red Stucco to match existing.
  2. The trim shall be wood painted  white milled  by a local mill worker to match  the

existing.

  1. The gutters  and leaders  shall be dark gray zinc coated copper from a local supplier to match  existing.
  2. The roof shall be dark gray existing  slate tile to remain.
  3. The windows  shall be painted  white  wood with woodstone  architectural  windows to match  existing.
  4. The exterior  doors:  (a) entry existing  wood door to be painted  white and reused;

and (b) all other doors  shall be Woodstone  Architectural  doors to match  existing, made  of wood and painted  white.

  1. Local river stone will be used to match  existing.
  2. The walkway  shall be natural  bluestone  to match  existing.
  3. The lighting  will be copper Bevolo,  “FQ-HC”  hanging  chain pendant.

HABR#  13- 08: Application   of Andrea  Currier  for review  of a replacement  greenhouse structure  at an existing  single-family   residence.  The premises  are located  at 8 Washington Spring Road, in the Town of Orangetown,  Hamlet  of Palisades,  New York.  Chapter  12, Section  12-4(A), Historic  Areas Board  of Review.

Heard by the HISTORIC  AREAS  BOARD  OF REVIEW  at a meeting  held on Tuesday, June  11, 2013 at which time the Board  made the following  determination:

 

 

 

Donald  and Randell  Bostwick  appeared. The following  documents  were presented:

  1. Survey  dated May  17, 2013 signed and sealed by James  E. Drumm,  L.S.
  2. Suburban  Sunrooms  plan  (32 pages) by Solar Innovations.
  3. Demo Plan, Elevations  & Notes  signed and sealed by Jonathan  Bostwick, Architect.

 

Donald  Bostwick,  Architect,  stated that the house  sits on river front property;  that there  is a main house, pool house  and the greenhouse  at the bottom  of the hill; that there are formal  gardens  on the property;  that the greenhouse  space has a heated  floor; that the structure  was imported  from England  in the early 80’s;  that it has single pane glass and is in poor shape;  that it is beyond  repair; that Ms. Currier  would  like to replace  it, but keep the potting  shed with the metal roof and compliment  it with the new energy efficient  structure;  that part of the new structure  would  have a standing seam copper roof to match  the existing  potting  shed; that the original  door with its  · brass hardware  would  be re-used;  and the new structure  would  be darker, bronze aluminum.

FINDINGS   OF FACT:

 

The Board,  after personal  observation  of the property,  hearing  all the testimony  and reviewing  same, found as fact, that: The application  as presented,  would  not adversely  affect the Historic  District  and the surrounding  area. The design  and

materials  for the proposed  greenhouse  (Survey  dated May  17, 2013 signed  and sealed by James  E. Drumm,  L.S.;Suburban   Sunrooms  plan (32 pages) by Solar Innovations;Demo Plan, Elevations & Notes signed and sealed by Jonathan Bostwick, Architect)  are complimentary to the District.

 

  1. The roof shall be copper.
  2. The greenhouse structure shall be prefabricated bronze aluminum with insulated

low e glass.

  1. The original stone potting shed shall be preserved.
  2. The gutters and leaders shall be copper.
  3. The door from the original greenhouse shall be saved and reused with the original

bronze hardware.
