SPECIAL TOWN BOARD MEETING

TUESDAY, SEPTEMBER 8, 2009

This Special Town Board Meeting was opened at 9:27 p.m. from the Workshop Meeting. Supervisor Kleiner presided and the Town Clerk called the Roll.  Present were:

 

Councilman Denis Troy

Councilwoman Marie Manning

Councilwoman Nancy Low-Hogan

Councilman Michael Maturo

 

Also present:   Charlotte Madigan, Town Clerk,

Eliot Tozer, Deputy Supervisor

John Edwards, Town Attorney

Teresa Kenny, First Deputy Town Attorney

Suzanne Barclay, Executive Assistant to the Supervisor

Charles Richardson, Director of Finance

James Dean, Superintendent of Highways

Ron Delo, Director of the Dept. of Envtl Management & Engineering

Sgt. Gerald Bottari, Police Dept.

Paul Witte, Code Enforcement Officer

Aric T. Gorton, Superintendent Parks-Rec. & Building Maint.

 

Charlotte Madigan led the Pledge of Allegiance to the Flag.

 

On Friday, September 11th, a Memorial Observance will be held on the Town Hall lawn at 6:30 p.m.  On Saturday, September 12th a vigil will be held for Chance Cosgsrove at Veteran’s Park starting at 6:00 p.m.

 

RESOLUTION NO.  495                                         OPEN PH/PROPERTY MAINTENANCE VIOLATION/3 FERN OVAL EAST  ORANGEBURG (70.14-2-43)

 

Councilman Maturo offered the following resolution, which was seconded by Councilwoman Manning and was unanimously adopted:

 

RESOLVED, that the 8:05 p.m. public hearing to consider Property Maintenance Violations (Section 24C of the Town Code), for property located at 3 Fern Oval East, Orangeburg, NY (70.14-2-43) is hereby opened.

Paul Witte, Code Enforcement Officer, said the original complaint was received on June 8th.  The Building Department sent certified letters to the owner of record in compliance with the Town Code and the letters came back undeliverable.  Notice of Violation was posted on the property, as well as being sent certified, return receipt and regular mail and these also came back undeliverable.  We are unable to contact anyone to get the property in compliance.  The house is vacant and the grass is a couple of feet high.

 

RESOLUTION NO. 496                                          CLOSE PUBLIC PORTION/PROPERTY MAINTENANCE VIOLATION/3 FERN OVAL EAST/ORANGEBURG (70.14-2-43)

 

 

Councilman Troy offered the following resolution, which was seconded by Councilwoman Low-Hogan and was unanimously adopted:

RESOLVED, that the public comment portion is hereby closed.

RESOLUTION NO. 497                                          ADOPT/PROPERTY MAINTENANCE VIOLATION/3 FERN OVAL EAST ORANGEBURG (70.14-2-43)

 

                        Councilman Troy offered the following resolution, which was seconded by Councilman Maturo and was unanimously adopted:

 

RESOLVED, that upon the failure of the owner, tenant or occupant with Notice to correct conditions complained of, the Town Board directs that the grass be cut by the Town of Orangetown, its designee or agent, or a private contractor for the property located at 3 Fern Oval East, Orangeburg, NY (70.14-2-43).

RESOLUTION NO. 498                                          ADJOURNED STBM AND ENTER AUDIT MEETING

 

Councilman Troy offered the following resolution, which was seconded by Councilwoman Manning and was unanimously adopted:

 

RESOLVED, that the Town Board adjourned the Special Town Board Meeting and entered the Audit Meeting at 9:33 p.m.

RESOLUTION NO. 499                                          PAY VOUCHERS

 

Councilman Troy offered the following resolution, which was seconded by Councilwoman Manning and was unanimously adopted:

 

RESOLVED, that the Finance Office is hereby authorized to pay vouchers for General Fund, Town Outside Village, Blue Hill, Broadacres, Highway, Sewer, Capital Projects, Risk Retention, Special Election and Parking Funds, for a total amount of $3,082,067.23.

RESOLUTION NO. 500                                          ADJOURNED AUDIT MEETING AND REENTERED WORKSHOP

 

Councilman Troy offered the following resolution, which was seconded by Councilwoman Manning and was unanimously adopted:

 

RESOLVED, that the Town Board adjourned the Audit Meeting and reentered the Workshop Meeting at 9:35 p.m.

RESOLUTION NO. 501                                          ADJOURNED WORKSHOP/ENTERED BUDGET HEARING

 

Councilman Troy offered the following resolution, which was seconded by Councilwoman Manning and was unanimously adopted:

 

RESOLVED that the Town Board adjourned the Workshop Meeting and entered a Budget Hearing  at 10:30 p.m.
