Orangetown Updates

6/12/2023
The Town of Orangetown just received a decision from Judge Christie D’Alessio, New York State Supreme Court, Rockland County, which granted the Town’s request for a Preliminary Injunction against the Armoni Hotel. This decision upholds the Town’s right to enforce its zoning laws and to not permit the Armoni Hotel to operate as a shelter for the homeless for the City of New York. This order maintains the status quo while the Town’s underlying case against the hotel continues. A copy of the Court’s decision is HERE.

Late yesterday, the Town of Orangetown obtained a Temporary Restraining Order from the Supreme Court, Rockland County enjoining the use of the Armoni Inn & Suites for the long-term housing of individuals under the care of New York City. To be very clear, the legal status of these individuals is irrelevant to this matter or to the Town’s decision to seek legal recourse.

The Town sought this restraint to ensure the integrity of local zoning regulations. These regulations, as the Court observed, are in place to protect the public health, safety and welfare. The immediate conversion of the Armoni Inn & Suites – a hotel that serves as a place of overnight accommodation for transient occupants – into a housing facility for long-term residence violates local zoning standards. The steps taken by the Town, and the Temporary Restraining Order issued by the Court, are for the protection of those who would be housed in the Armoni Inn & Suites on a long-term basis, as well as the community at large. Thank you Legislator Hood for recognizing the obvious problems with this program being implemented so hastily and without any input from the County. Orangetown and all of the towns in Rockland are welcoming communities to all, but we deserved to be included in substantive discussions about this plan and its impact to our communities. This is not a Republican or Democrat issue, but one that may have huge financial implications for Rockland County for years to come. I applaud your efforts to have the Mayor reconsider this plan at this time.

𝐒𝐭𝐚𝐭𝐞𝐦𝐞𝐧𝐭 𝐅𝐫𝐨𝐦 𝐑𝐨𝐜𝐤𝐥𝐚𝐧𝐝 𝐂𝐨𝐮𝐧𝐭𝐲 𝐋𝐞𝐠𝐢𝐬𝐥𝐚𝐭𝐮𝐫𝐞 𝐂𝐡𝐚𝐢𝐫𝐦𝐚𝐧 𝐉𝐚𝐲 𝐇𝐨𝐨𝐝 𝐉𝐫.
We are and have always been a nation of immigrants – people in search of freedom and democracy, who love their families and work hard to make their American dream come true. Immigrants built this country and continue to make it a better place every day.
Rockland County has always welcomed newcomers and this past year, which saw a significant influx of migrants to the county, has been no different, but it has placed a strain on local services.
Without consulting Rockland County officials, the New York City Mayor’s Office decided to send 340 migrants without a thought of whether Rockland would be able to care for these individuals.
Some facts that could have been shared had Mayor Adams reached out prior to deciding to send those 340 migrants to a hotel in Orangeburg.
Between September 2022 and March 2023, Rockland County experienced the following:- A 35 percent increase in the number of children under foster care.- More than 1,000 new students enrolling in a single school district, most needing ESL classes.- Food pantries that simply ran out of food.
– In April, Catholic Charities, one of the county’s nonprofit contract agencies, reported that more than 475 households sought food from its pantry, more than double the number seen three years ago.- In February, the county’s warming center averaged more than 60 guests per night, with 220 individuals receiving services, an increase of 50 percent versus the previous year.- More than 80 people are currently homeless in Rockland County, but through a variety of partnerships, are being housed and receiving the types of services that will hopefully result in permanent housing.
– There is a tremendous shortage of affordable housing in Rockland County and several nonprofits, including Catholic Charities, have expressed concern about meeting the need for residents already here and receiving services, let alone trying to help additional newcomers.
Migrants in need of assistance have fled not only extreme poverty, but failed regimes, gang warfare, drug cartels and much more. Many have arrived in the United States with little more than the clothes they are wearing and sometimes, a small bag of personal belongings. These are human beings in need and they don’t need to be pawns in a political tussle. They need housing, food, medical attention, education, and jobs – and they will need support for months.
Rockland County is not set up to handle such demands nor should local taxpayers have to bear the load of such expenses. Clearly, the Federal Government in Washington needs to act – all of Washington – the President, the House and the Senate to either stem the tide of migrants or find a system to help these individuals.
In the meantime, Rockland County legislators are reaching out to the New York City mayor’s office. We will be asking him to reconsider his ill-conceived plan.
An uncoordinated effort to drop people off by the bus load is just not a workable solution. It’s an irresponsible plan that helps no one, not the migrants, local residents, taxpayers or town and county governments left shouldering the burden.

Yesterday, the Town Building Inspector served a Notice of Violation upon the Armoni Inn and Suites based upon observations made by the Town Fire Inspector and Assistant Building Inspector. During their inspection, they observed preparations to turn the hotel essentially into a NYC-run shelter. That use constitutes a violation of the Certificate of Occupany for the hotel. Yesterday, at the Special Town Board meeting, the Board authorized the hiring of outside legal counsel to assist the Town in connection with the plan of NYC Mayor Eric Adams to transfer hundreds of migrants from his sanctuary city to Orangetown, including looking into what legal rights the Town may have, including commencing litigation.

In addition, I have already spoke with US Rep. Michael Lawler about the situation and he is doing everything he can to assist the Town and County. Anyone who has an issue with the border crisis, which is now directly impacting the Town of Orangetown, may want to contact your United States Senators to ask what they are doing, if anything, to assist Orangetown and to address the border crisis. Rockland Declares State of Emergency
New City, NY – Rockland County Executive Ed Day has declared a State of Emergency in response to the City of New York planning on housing about 340 adult males in Armoni Inn and Suites in Orangeburg for four months followed by attempted integration into the County. The County informed New York City Mayor Eric Adams yesterday that Rockland would not allow this plan to stand and has enacted this State of Emergency in direct response.
“The City declared itself a Sanctuary City in December of 2016 committing itself to supporting undocumented individuals while this County has not for the simple fact that we are one tenth the population of New York City and incapable of receiving and sustaining the volume of undocumented migrants Mayor Eric Adams intends to send over,” said County Executive Ed Day. “This County already has a housing crisis due to the lack thereof and lack of affordable housing options. This crisis is so extreme that Rockland has been unprecedently deputized by the State of New York to take over Building and Fire Code enforcement in the Village of Spring Valley. Sending busloads of people to this County that does not have the infrastructure to care for them will only compound that issue tenfold while straining support systems that are already at a breaking point.”
Due to the County of Rockland already struggling with the natural and organic migration of people into the County, including school districts rapidly gaining population and stressing services, this administration is enacting a local State of Emergency effective May 6, 2023, and remain in effect for 30 days at which time it may be extended. This State of Emergency prohibits other municipalities from bringing and housing people in the County and prohibits hotels and motels from housing immigrants without a license and requires any municipalities that might bring migrating or asylum-seeking people into Rockland County to ensure they will be fully cared for and paid for.
The specific License requirements are listed in the attached SOE – Sustainable Migration Protocol.
In March the County of Rockland publicized the strain to schools, food pantries, housing, and social services already being endured due to an increasing number of undocumented individuals resettling in Rockland.
While city officials allege they will provide some short-term funding and services to these individuals, no realistic plans have been communicated as to who will house, feed, and support these individuals in the long-term.
“Mayor Eric Adams is criticizing Congress for their failure to establish a strategy for each migrant before they enter into the country, ensuring this crisis is dealt with in a coordinated manner, and then does the exact opposite – shipping new arrivals to other municipalities that do not have the infrastructure to support them,” said County Executive Day. “As I said yesterday, it’s the same as tossing people into the middle of the ocean with nowhere to swim.”
“Our current system is not built to support large influxes of population seekers,” said DSS Commissioner Joan Silvestri. “Social Services funding is also not applicable to undocumented individuals, so we have no financial support to help those without a legal status.”
“Congress and the President need to wake up and do what needs to be done by fixing our broken immigration system once and for all,” concluded County Executive Day. “This is not about being anti-immigration but as it stands the system is incentivizing illegal immigration which does nothing to support our infrastructure; rather it is just draining taxpayer resources from the families already here and struggling including homeless, disabled, seniors, low-income, and other vulnerable populations.”

Please be advised that the Town Board will be having a special Town Board meeting at 5 pm today at Town Hall to consult with legal counsel about the on-going concern of the NYC Mayor’s plans to bus and house migrants to a Orangeburg hotel. The meeting will be in Executive Session and no public comment will be taken.
I would also like remind everyone that spreading false information and using inflammatory speech does not help. We are better than that and, at a time when the eyes of the entire country are upon us, let’s prove it. To clear up some of the misinformation, no one in Orangetown or Rockland County had advance notice of this plan, or how imminent it was, until yesterday at 1:25 pm. The Town did not approve it (not that we were asked) or agree to it, and is looking into every legal avenue to see if it can be stopped. I suspect that the very short advance notice was part of the plan.
I also want to thank County Executive Ed Day and his staff for stepping up on a Friday afternoon, and into the evening, to assist my office in obtaining information and offer of assistance.

I will continue to update on this matter as credible information becomes available.

NYC Eric Adams called me earlier today to notify me of plans to house migrants at a hotel in Orangetown, which I later learned was the Armoni Inn located in Orangeburg. Upon receiving this call, I immediately contacted our County Executive Ed Day and other State and Local elected leaders to address what is an issue of obvious concern to the residents of the Town of Orangetown. The Town of Orangetown and Rockland County are small localities that are not equipped to handle this sudden increase in the need for services as County Executive Day and the Commissioner of Social Services have pointed rightly out.
I agree that this calls for a Federal, not a local solution. The people that NYC is sending to Orangetown have been failed first by the Federal government, which has not adequately addressed immigration issues, and now by the City of New York, which had let people know that they would take them in as a sanctuary city. To send these people to a location that is not equipped to meet their needs, is a betrayal of that often-expressed desire by NYC to be a sanctuary for them.
The Town Board will continue to monitor this situation closely and is doing all that it can with local, state and federal officials to address this unfortunate passing of the buck by, first, the federal government, and now NYC.
