TOWN OF ORANGETOWN

PUBLIC HEARING/WORKSHOP

TUESDAY, OCTOBER 19, 2010

This Public Hearing was opened at 8:00 p.m.  Supervisor Whalen presided and the Town Clerk called the Roll.  Present were:

 

Councilman Denis Troy

Councilwoman Nancy Low-Hogan

Councilman Michael Maturo

Councilman Thomas Diviny

 

Also present:   Charlotte Madigan, Town Clerk

John Edwards, Town Attorney

Teresa Kenny, First Deputy Town Attorney

AnnMarie Hahr, Executive Assistant to the Supervisor

Charles Richardson, Director of Finance

James Dean, Superintendent of Highways

Robert Simon, Receiver of Taxes

John Giardiello, Director of OBZPAE

 

Charlotte Madigan led the Pledge of Allegiance to the Flag.

 

RESOLUTION NO. 617                                          OPEN PH/PROPERTY MAINTENANCE VIOLATION/75 MOUNTAINVIEW AVE

 

Councilman Troy offered the following resolution, which was seconded by Councilwoman Low-Hogan and was unanimously adopted:

 

RESOLVED, that the 8:00 p.m. public hearing, pursuant to Chapter 24C-15 of the Town Code, to consider Property Maintenance Violations (Section 24C of the Town Code) and performing work at the property known as 75 Mountainview Avenue, Pearl River, S/B/L 69.17-5-1.2 is hereby opened.

 

Ayes:               Councilpersons Troy, Low-Hogan, Maturo, Diviny

Summary of Public comments:

Joan Bourke, Pearl River, presented pictures and said it is just a matter of time before some one seriously hurts themselves at this property.  It is a complete safety hazard.  It is overgrown with weeds, litter, empty beer cans and the foundation walls are covered with graffiti.  She asked that something be done.

 

John Giardiello, Director of OBZPAE, said the Town requested three estimates but has only received one of $2,800 to clean and remove debris from this property.

 

RESOLUTION NO.  618                                         CLOSE PH/PROPERTY MAINTENANCE VIOLATION/75 MOUNTAINVIEW AVE

 

Councilwoman Low-Hogan offered the following resolution, which was seconded by Councilman Troy and was unanimously adopted:

 

RESOLVED, that the public portion is hereby closed.

RESOLUTION NO. 619                                          LEAD AGENCY/PROPERTY MAINTENANCE VIOLATION                         75 MOUNTAINVIEW AVE

 

Councilman Troy offered the following resolution, which was seconded by Councilwoman Low-Hogan and was unanimously adopted:

Resolution No. 619 – Continued

 

RESOLVED, that the Town Board declares itself Lead Agency in this unlisted matter.

RESOLUTION NO. 620                                          SEQRA DECLARATION/PROPERTY MAINTENANCE VIOLATION              75 MOUNTAINVIEW AVE

 

Councilman Troy offered the following resolution, which was seconded by Councilwoman Low-Hogan and was unanimously adopted:

 

RESOLVED, that a SEQRA Declaration of non-significance, indicating that the action the Town Board is contemplating will not have a significant negative impact on the environment, is hereby adopted; a copy is labeled Exhibit 10-A-10 and made a part of these minutes.

RESOLUTION NO. 621                                          ADOPT/PROPERTY MAINTENANCE VIOLATION/75 MOUNTAINVIEW AVE

 

Councilman Troy offered the following resolution, which was seconded by Councilwoman Low-Hogan and was unanimously adopted:

 

RESOLVED, that upon the failure of the owner, tenant or occupant with Notice to correct property maintenance violations, the Town Board directs the Town of Orangetown, its designee or agent, or a private contactor to clean-up the property located at 75 Mountain View Avenue, Pearl River (69.17-5-1.2), with a lien placed on the property, at a cost not to exceed $5,000, and the bid be awarded by October 31, 2010.

RESOLUTION NO. 622                                          ENTER WORKSHOP

 

Councilman Maturo offered the following resolution, which was seconded by Supervisor Whalen and was unanimously adopted:

 

RESOLVED, that the Town Board entered the Workshop at 8:15 p.m.

RESOLUTION NO.             623                                          ADJOURNMENT

 

Councilman Troy offered the following resolution, which was seconded by Councilman Maturo and was unanimously adopted:

 

RESOLVED, that the Town Board adjourned at 10:05 p.m.
