POLICE COMMISSION/WORKSHOP

EXECUTIVE SESSION

TUESDAY, MAY 13, 2014

 

This Police Commission Meeting was opened at 7:00 p.m. Supervisor Stewart presided and the Town Clerk called the roll.

 

Present were:  Councilman Denis Troy

Councilman Thomas Diviny

Councilman Thomas Morr

Councilman Paul Valentine

 

Also present:

Charlotte Madigan, Town Clerk

John Edwards, Town Attorney

Jeff Bencik, Finance Director

Kevin Nulty, Police Chief

 

Charlotte Madigan led the Pledge of Allegiance to the Flag.

 

RESOLUTION NO. 275                                          POLICE MATTERS/EVENTS

 

Councilman Diviny offered the following resolution, which was seconded by Councilman Valentine and was unanimously adopted:

 

RESOLVED, that the Town Board entered the Police Commission Meeting to discuss Police matters and community events.

RESOLUTION NO. 276                                          ENTERED WORKSHOP

 

In attendance, at this Workshop were Supervisor Stewart, Councilmen Troy, Diviny, Morr and Valentine, Charlotte Madigan, John Edwards, Jeff Bencik, Jim Dean, Aric Gorton, Joe Moran and John Giardiello.

 

Supervisor Stewart offered the following resolution, which was seconded by Councilman Troy and was unanimously adopted:

 

RESOLVED, that the Town Board entered the Workshop Meeting at 8:00 p.m.

RESOLUTION NO. 277                                           SPARKILL WATER QUALITY AUTHORIZATION/US HEALTH AND HUMAN SERVICES AGENCY FOR LAND TITLE/335 WESTERN HWY TAPPAN

 

Councilman Troy offered the following resolution, which was seconded by Councilman Diviny and was unanimously adopted:

 

WHEREAS, certain real property owned by the United States, located in the County of Rockland, State of New York, has been declared surplus and is subject to assignment for disposal for public health purposes by the Secretary of Health and Human Services
under the provisions of Section 203(k)(1) of the Federal Property and Administrative Services Act of 1949, as amended, and regulations promulgated pursuant thereto, more particularly

described as follows: (full legal description is not required at this time)]: The lower portion of the Homes for Heroes site in Tappan, 335 Western Highway, Tappan, NY 10983.

 

WHEREAS, the Town of Orangetown, needs and can utilize said property for public health purposes in accordance with the requirements of said Act and the rules and regulations promulgated pursuant thereto, of which this Board is fully informed, including commitments regarding use and time within which such use shall commence.

NOW, THEREFORE, BE IT RESOLVED, that Town of Orangetown has legal authority, is willing, and is in a position financially and otherwise to assume immediate care and maintenance of the property, and that Andrew Stewart, Town Supervisor, James Dean, Highway Superintendent and John Edwards, Town Attorney, are hereby authorized, for and on behalf of the Town of Orangetown to do and perform any and all acts and things which may be necessary to carry out the foregoing resolution, including the preparing, making, and filing of plans, applications, reports, and other documents; the execution, acceptance, delivery, and recordation of agreements, deeds and other instruments pertaining to the transfer of said property; and the payment of any and all sums necessary on account of the purchase price thereof, including fees or costs incurred in connection with the transfer of said property for surveys, title searches, appraisals, recordation of instruments, or escrow costs, together with any payments by virtue of
nonuse or deferral of use of the property.

If the applicant is unable to place the property into use with the time limitation indicated below (or determines that a deferral of use should occur), it is understood that the Town of Orangetown will pay to the Department of Health and Human Services for each month of nonuse beginning twelve (12) months after the date of the deed, or thirty-six (36) months where construction or major renovation is contemplated, the sum of 1/360 of the then market value for each month of nonuse.

If the Department of Health and Human Services approves the application, the board will file a copy of the application and standard deed/lease with their permanent minutes.

RESOLUTION NO. 278                                                ESTABLISH POSITION/ENGINEER II DEME

 

Councilman Valentine offered the following resolution, which was seconded by Supervisor Stewart and was unanimously adopted:

 

RESOLVED upon the recommendation of the commissioner of DEME and approval by the Rockland County Department of Personnel establish the position of Engineer II in the Department of Environmental Management and Engineering.

In attendance, at this Executive Session, were Supervisor Stewart, Councilmen Troy, Diviny, Morr and Valentine, John Edwards, Jeff Bencik, and John Giardiello.

 

RESOLVED, that the Town Board entered Executive Session to discuss particular personnel, regarding hiring of a Building Inspector, at 10:00 p.m.

RESOLUTION NO. 280                                          RE-ENTER WORKSHOP/ADJOURNED

RESOLVED, that the Town Board re-entered the Workshop Meeting and adjourned at 10:50 p.m.
