HABR#19-15: Application of Portuguese Style BBQ Grill & Bar for review of a sign at a new restaurant. The premises will be located at 61 -67 Old Tappan Road, in the Town of Orangetown, Hamlet of  Tappan, New York. Chapter 12 of the Code of the Town of Orangetown, Section 12-4(A), Historical Areas Board of Review.

Tax Map Designation:  77.10 / 3 / 18; CS zoning district

 

Heard by the HISTORICAL AREAS BOARD OF REVIEW at a meeting held on Tuesday, September 10, 2019 at which time the Board made the following determination:

 

Evert Ruiz AND Edwin Rodriguez appeared.

 

The following documents were presented:

 

  1. Site plan not dated signed and sealed by Winston Rafael Garcia, P.E., labeled “ 65 Old Tappan Road” 1 page.
  2. Picture of the proposed sign with specs from Hispana Signs (1 page).

 

 

 

Edwin Rodriguez stated that the existing sign is a temporary sign that was made to look like the sign that they are proposing to have made in wood; that they would like to bring a different kind of food to the area; that he graduated from Tappan Zee High School; that they understand that they can light the sign from front with overhead lighting or b from below with exterior illumination and that they can place an open sign outside the establishment on an easel with a light on it; and that they understand that no neon lights are permitted in the windows.

FINDINGS OF FACT:

 

The Board, after personal observation of the property, hearing all the testimony and reviewing all drawings and plans, and other submissions, correspondence and reports (if any), found as fact, that: The application as presented, would not adversely affect the Historical Areas and the surrounding area. The design and materials for the proposed sign is approved:

 

  1. The sign is HDU Routed Board Sign 9’ W x 2’ 6” H x 4’ D.
  2. The materials for the sign are 1 ½” high density urethane, routed, painted with 1 shot sign paint.
  3. The shall be attached to the wall with Aluminum “L’s” & studs and metal screws to brick mortar.
  4. The face of the sign is black (199L); the lettering is white, the border is 1 shot metallic brass (#111L) and the exterior border is 1 shot (#102L) fire Red.

 

THis APPROVAL/decision, INCLUDING THE BOARD’S REQUIRED  modifications TO THE APPLICANT’S DRAWINGS AND /OR PLANS, or conditions set forth herein, if any, IS GRANTED BY THE historical areas board of review subject to any such conditions and/or modifications, and is LIMITED TO THE SPECIFIC RELIEF REQUESTED HEREIN.

 

** PRE-1918 CONSTRUCTION: please be advised: In the Historic Area, all construction requiring a building permit or any exterior changes (including paint color) to buildings constructed prior to 1918, requires approval from the historicAL areas board of review.

DECISION: In view of the foregoing, and after personal observation of the property, hearing all the testimony before the Board, and reviewing all drawings and plans, and other submissions, correspondence and reports ( if any), the application for the sign is APPROVED.

 

The foregoing resolution to approve the sign as presented with permission to light the sign from above or below with exterior illumination and permission to place a non-illuminated open sign on an easel outside the establishment with exterior lighting on the sign;  was presented and moved by  Larry Bucciarelli, seconded by  William Walther;  and carried as follows: William Walther, aye; Margaret Raso, aye; Larry Bucciarelli, aye;  Carol Schelin, aye; Loren Plotkin, aye; and Scott Wheatley, aye. Thano Schoppel was absent.

 

 

 

The Administrative Aide to the Board is hereby authorized, directed and empowered to sign this decision and file a certified copy thereof in the office of the Town Clerk.
