Town Board Reorganizational Meeting January 5th, 2016

REORGANIZATIONAL MEETING

TUESDAY, JANUARY 5, 2016

 

This Town Board Meeting was opened at 7:30 p.m.  Supervisor Stewart presided and Charlotte Madigan, Town Clerk, called the Roll.  Present were:

 

Councilman Denis Troy

Councilman Thomas Diviny

Councilman Paul Valentine

Councilman Gerald Bottari

 

Also present:   Charlotte Madigan, Town Clerk

John Edwards, Town Attorney

Teresa Kenny, First Deputy Town Attorney

James Dean, Superintendent of Highways

Joseph Moran, Commissioner of DEME

Robert Simon, Receiver of Taxes

Aric Gorton, Superintendent of Parks and Recreation

Kevin Nulty, Police Chief

Allan Ryff, Deputy Supervisor

Elijah Reichlin-Melnick, Supervisor’s Confidential Assistant

Anthony Bevelacqua, IT Specialist

Matthew Lenihan, Computer Operator

 

Orangetown Police Honor Guard presented the Colors.

 

Pledge of Allegiance to the Flag of the United States of America was led by the Community.

 

The Star Spangled Banner, arranged by Darmon Meader, and Berusa Er! By Sten Kallman:  Nyack High School Advanced Chorus, directed by Drucilla Pluhowski.

The Honorable Richard Finning administered the Oath of Office to Charlotte Madigan, Town Clerk.

 

Charlotte Madigan, Town Clerk, administered the Oath of Office to:

 

Andrew Stewart, Town Supervisor

Paul Valentine, Town Council

Jerry Bottari, Town Council

Jim Dean, Town Superintendent of Highways

Patrick Loftus, Town Justice

 

Orangetown Police Honor Guard retired the colors.

 

 

2016 STATE OF THE TOWN SPEECH:  Town Supervisor Andy Stewart

 

Supervisor Stewart made the following reappointments:

 

Jeff Bencik, Finance Director

Elijah Reichlin-Melnick, Assistant to the Supervisor

Allan Ryff, Deputy Supervisor

 

The Town Board and all of the Elected Officials wished everyone a Happy Healthy New Year.  They thanked everyone for their support and they look forward to resolving many Town issues.

RESOLUTION NO. 1                                              OFFICIAL UNDERTAKING/ELECTED AND APPOINTED OFFICIALS

 

Supervisor Stewart offered the following resolution, which was seconded by Councilman Diviny and was unanimously adopted:

 

RESOLVED,   upon the recommendation of the Director of Finance, Jeff Bencik, to approve Official Undertaking to be filed in the Rockland County Clerk’s Office for elected and appointed officials, officers and employees as the Town Board may require for the faithful performance of their duties and the prompt and proper account for paying over all money received by said employees in their official capacities.

RESOLUTION NO. 2                                              2016/MARRIAGE OFFICERS

 

Supervisor Stewart offered the following resolution, which was seconded by Councilman Diviny and was unanimously adopted:

 

RESOLVED, that the following are designated as Marriage Officers, effective January 1-December 31, 2016, at no salary.

RESOLUTION NO. 3                                              OFFICIAL NEWSPAPERS

 

Councilman Bottari offered the following resolution, which was seconded by Councilman Troy and was unanimously adopted:

 

RESOLVED, that the Town Board hereby designates the Journal News as the official newspaper of the Town pursuant to NYS Town Law Section 64 (11), and the Our Town and Rockland County Times, for additional notice as the Board may determine necessary or advisable, on a case by case basis.

RESOLUTION NO. 5                                              2016 RECEIVER OF TAXES BANKING DEPOSITORIES

 

Councilman Troy offered the following resolution, which was seconded by Supervisor Stewart and was unanimously adopted:

 

RESOLVED, that the following banks are designated as the banking depositories for the Receiver of Taxes:

RESOLUTION NO. 6                                              REAPPOINT/REGISTRAR OF VITAL  STATISTICS/CHARLOTTE MADIGAN

 

Councilman Diviny offered the following resolution, which was seconded by Councilman Valentine and was unanimously adopted:

 

RESOLVED, that Charlotte Madigan, Town Clerk, is hereby reappointed Registrar of Vital Statistics, effective January 1, 2016 through December 31, 2017.

RESOLUTION NO. 9 – Continued

 

RESOLVED, that Teresa Accetta-Pugh is hereby reappointed Deputy Town Clerk and Deputy of Vital Statistics, and Rita McCabe is hereby appointed Deputy Town Clerk, to serve at the pleasure of the Town Clerk, acting as substitutes with legislative powers, effective January 1, 2016.

RESOLUTION NO. 10                                            REAPPOINT JOHN EDWARDS/TERESA KENNY/TOWN ATTORNEYS/2016-2017

Councilman Troy offered the following resolution, which was seconded by Supervisor Stewart and was unanimously adopted:

RESOLVED, that the Town Board hereby reappoints John Edwards and Teresa Kenny as Town Attorneys, effective January 1, 2016 through December 31, 2017.

RESOLUTION NO. 11                                            AMEND/TOWN’S PROCUREMENT TRAVEL POLICY

Supervisor Stewart offered the following resolution, which was seconded by Councilman Bottari and was unanimously adopted:

RESOLVED, that the Town’s Procurement and Travel policy is hereby amended to reflect a mileage reimbursement rate of $0.54 cents per mile, as determined by the Internal Revenue Service.

RESOLUTION NO. 12                                            GRANT PERMISSION/PO DANIEL RYAN/PO BRANDON MYERS/PO ELIZABETH MUCKELL/NYS ACADEMY OF FIRE SCIENCE (DARE)/JANUARY 18-29, 2016

Councilman Valentine offered the following resolution, which was seconded by Supervisor Stewart and was unanimously adopted:

RESOLVED, that permission is hereby granted to PO Daniel Ryan, PO Brandon Myers and PO Elizabeth Muckell, to attend the DARE Instructor School, at the New York State Academy of Fire Science, Montour Falls, NY, from January 18-29, 2016.  Expenses to be paid by the Town would include up $350.00 per day, per officer for meals, paid from Account B.3210.480.16 with use of Police Department vehicles, fuel and EZ-pass for travel.

RESOLUTION NO. 13                                            ENTER EXECUTIVE SESSION BLUE HILL GOLF COURSE RESTAURANT 

 

In attendance, at this Executive Session, were Supervisor Stewart, Councilmen Troy, Diviny, Valentine, and Bottari, Charlotte Madigan, John Edwards, Teresa Kenny, and Aric Gorton.

 

 

RESOLUTION NO. 13 – Continued

 

Councilman Troy offered the following resolution, which was seconded by Supervisor Stewart and was unanimously adopted:

 

RESOLVED, at 9:20 p.m., the Town Board entered Executive Session to discuss the restaurant at the Blue Hill Golf Course.  Supervisor Stewart said no further votes will be taken.

RESOLUTION NO. 14                                            ADJOURNED/MEMORY

 

Supervisor Stewart offered the following resolution, which was seconded by Councilman Diviny and was unanimously adopted:

 

RESOLVED, at 9:54 p.m., the Town Board re-entered the Re-Organzational Meeting and adjourned, in memory of James Bredin, Pearl River; Peter Gionta, Pearl River; Albert Jordan, Sparkill and Lillian LaPlaca, Blauvelt.
