New York State Same Sex MarriageThe State's highest court has found that the State Domestic Relations Law limits marriage to opposite sex couples and that the NY State Constitution does not change that. The Court stated that whether such marriages should be recognized is a question to be addressed by the State Legislature. Thus, until State law is changed by the State Legislature, town clerks are not authorized to issue marriage licenses to same sex couples. Hernandez v.
