5. WHEREAS, the Town Board has considered a proposal to amend the map of the Palisades Historic Area by adding the following properties to the Area:

36 Lawrence Lane 80.07-1-15

40 Lawrence Lane 80.07-1-16

31 Heyhoe Woods Road 78.13-1-4

46 Heyhoe Woods Road 78.13-1-5

95 Closter Road 80.05-1-47

and subtracting the following property from the District:

9 Centrury Lane 80.05-1-40

and

WHEREAS, the Town Board, upon notice, conducted a Public Hearing on January 14, 2008 and February 11, 2008 to consider the proposal, said notice being in the form of newspaper publication and individualized notice to the individual property owner, via United States First Class Mail and property posting, for each session of the Public Hearing, and

WHEREAS, at each session of the Public Hearing, the Town Board carefully reviewed a presentation, which included maps and reports, setting forth facts and circumstances in support of the proposed amendments, and carefully reviewed all public comments, both oral and written, relating to the proposal, be it hereby

RESOLVED, that said proposal is a "Type II" action under Section 617.5(c)(32) of the State Environmental Quality Review Act (SEQRA), and as such, does not require SEQRA review, and be it hereby

FURTHER RESOLVED, that the Town Board, upon full consideration of all of the above, hereby finds, ascertains, and determines that said proposal, in its entirety, furthers the legislative goals set forth in Sections 12-1 and 12-7 of the Town Code of the Town of Orangetown and Section 96-a of the General Municipal Code of the State of New York, directs the Director of the Town of Orangetown's Office of Building, Zoning and Planning Administration and Enforcement to cause a new and amended map be drafted and filed with the Office of the Town Clerk, according to Section 12-2 of the Town Code of the Town of Orangetown, said map being consistent with this Resolution, and directs the Town Clerk to accept and file said map in place of the previous map, and to make it available to any interested person upon request.

Consider the request of the Pearl River Parks & Activity Committee Inc. for three yards of sand, trash receptacles and clean up of field, barricades, and four portable toilets (two handicapped accessible) for the 4th of July Fireworks Display and Celebration on Friday, July 4, 2008 (rain date of July 6, 2008) to be charged to Account No. A7550/50457.

7. Consider the request of John Sullivan of 185 Ridge Street, Pearl River, organizer of the John Bellew 5K Fun Run/Walk, for two portable toilets, trash receptacles, barricades and safety cones for the Fun Run on April 19, 2008, to be charged to Account No. A7550/50457.

8. Consider the request of YMCA for $2,500 to sponsor 20 Orangetown high school students to attend the YMCA Youth and Government Conference, March 15-17, 2008 in Albany NY, to be charge to Account No. A7550/50457.

9. Designate Fire Lanes at Cortland Gardens Apartments, 46-62 East Crooked Hill Road, Pearl River (S/B/L 68.12-2-6): the west side of the driveway beginning at East Crooked Hill Road and extending 332 feet into the complex; the east side of the driveway extending 141 feet from the northwest corner of the building south; and the east and west sides of the parking circle, and the entire area 35 feet in front of the southwestern most building.

10. Authorize James J. Dean, Superintendent of Highways, to attend the 2008 Summit and Grass Roots Campaign for Local Roads and Bridges from March 4-5, 2008 in Albany, NY at a cost of $212.00 plus the use of a Town car.

14. Accept and receive the Subdivision Performance Bond in the sum of $97,980.00 from Victoria Blickman Jacqueney, Trustee of Nancy C. Blickman, in favor of the Town of Orangetown as “Obligee” in connection with a certain subdivision known as the “Blickman Minor Subdivision”, and which said Performance Bond is collateralized by an Irrevocable Letter of Credit No. SDCMTN553279 (to expire on November 28, 2009), issued by HSBC Bank in favor of the Town of Orangetown.[Author ID0: at ]

15. Upon the recommendation of the Town Attorney's Office and the Assessor approve and authorize Dennis D. Michaels, Deputy Town Attorney, to sign the Stipulation and Order and Judgment Reducing Assessments regarding the tax certiorari proceeding 103 Gedney Street Owners, Inc. v. The Town of Orangetown, et al., Tax Map designation 66.31-1-1 for the tax assessment years 2002 through 2007, for a total refund by the County of $9,248, and for a total refund by the Town of $37,634.

16. Upon the recommendation of the Town Attorney's Office and the Assessor approve and authorize Dennis D. Michaels, Deputy Town Attorney, to sign the Stipulation and Order and Judgment Reducing Assessments regarding the tax certiorari proceeding Catherine Commons LLC v. The Town of Orangetown, et al., Tax Map designation 65.36-2-17.1, 17.2 & 17.3 for the tax assessment years 2003 through 2007, for a total refund by the County of $68 and for a total refund by the Town of $252 for Tax Lot 65.36-2-17.1; and a total refund by the County of $2,930 and for a total refund by the Town of $11,661 for Tax Lot 65.36-2-17.2. Tax Lot 65.36-2-17.3 is being discontinued with no reductions.

17. Upon the recommendation of the Town Attorney's Office and the Assessor approve and authorize Dennis D. Michaels, Deputy Town Attorney, to sign the Stipulation and Order and Judgment Reducing Assessments regarding the tax certiorari proceeding 5000 Inc. v. The Town of Orangetown, et al., Tax Map designation 66.46-1-54 for the tax assessment years 2002 through 2007, for a total refund by the County of $3,721, and for a total refund by the Town of $16,063.

18. Accept, receive and file in the Town Clerk's Office, a sanitary sewer easement from the Volunteer Fire Association of Tappan and authorize the Supervisor to sign a document evidencing the Town's intent to extinguish and/or abandon the existing easement that the Town currently has on the property, located at135 Washington Avenue, Tappan, New York.
